1. Agreement
These Terms of Use (“Terms”) govern your access to and use of Planner and related experiences we make available on the web, as installable or progressive mobile experiences, and on desktop where offered (collectively, the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
Planner helps you organize trip information such as destinations, dates, budgets, and optional integrations with third-party data or booking providers when enabled. Features may vary by platform (browser, mobile, or desktop). We may change, suspend, or discontinue parts of the Service with reasonable notice where practicable.
3. Accounts and eligibility
Where the Service requires an account, you must provide accurate information and keep credentials secure. You are responsible for activity under your account. You must be old enough to enter a binding contract where you live. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
4. Acceptable use
You agree not to misuse the Service, including by:
- Violating applicable law or third-party rights;
- Attempting to probe, scan, or test the vulnerability of any system or network without authorization;
- Circumventing access controls, quotas, or security features;
- Uploading malware or content intended to disrupt the Service;
- Reverse engineering the Service except where applicable law permits.
5. Third-party services
The Service may link to or rely on third-party maps, travel data, authentication, hosting, analytics, or payment providers. Their terms and privacy notices apply to your use of those services. Section is not responsible for third-party content, availability, or pricing.
6. Intellectual property
Planner, the Planner logo, and related branding are owned by Section LLC or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service for personal or internal business trip planning. You retain rights in content you submit; you grant us a license to host, process, and display that content as needed to operate the Service.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECTION LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TRAVEL DECISIONS AND PURCHASES ARE YOUR RESPONSIBILITY.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECTION LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), IF NO FEES APPLIED.
9. Indemnity
You will defend and indemnify Section LLC and its affiliates against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your misuse of the Service, or your violation of these Terms or applicable law.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access for conduct that violates these Terms or creates risk or legal exposure for us. Provisions that by their nature should survive will survive termination.
11. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise. Courts in Delaware have exclusive jurisdiction for disputes, where permitted by law.
12. Changes
We may update these Terms. We will post the revised version and update the “Last updated” date. Material changes may require additional notice where required by law. Continued use after changes become effective constitutes acceptance.
